The Club had not timely responded to a complaint filed by the NKCCA and the hearing was to set a Default Judgment against the Club.
Three individuals from the Club were present, as was attorney Joe Baker representing NKCCA. Commissioner Buster Norton was also present at the hearing. “I was there representing the county in case the Judge wanted some information from the county,” Norton told the Seymour Herald.
According to witnesses, the Judge inquired from the Club representatives where their attorney was. One of the representatives responded that Larry Water’s told him they didn’t need a lawyer. The Judge continued the trial so the Club could retain an attorney.
Following the hearing, Norton told the Club members he was going to inquire if the County Attorney could represent the Club.
The following the Commission meeting Monday evening, Norton asked Commissioner Brian Delius he would be interested in representing the Club.
“We are ready to follow up with depositions and continue on with the case if the Optimists are still interested in pursuing this matter,” Baker told the Seymour Herald.
The NKCCA is objecting to the Club’s construction of a full blown ballpark in the community which, according to NKCCA would endanger the kids, the parents and the overall traffic situation. The NKCCA believes the area would be better served with a community park.
