The Seymour Zaxby's restaurant, which just opened in March of this year, was seized for unpaid taxes Thursday. The Seymour location is co-owned with the Sevierville location. Both restaurants were seized and posted by the Tennessee Department of Revenue for unpaid taxes.

The sign on the front door at both locations, in Seymour and on Winfield Dunn Parkway in Sevierville, states "Property has been seized" for nonpayment of state taxes.

It was reported in the Seymour Herald last month that the Zaxby's lease was for sale.

"The food quality and quantity has been diminishing for several months, maybe this is why," stated a Zaxby's customer that wished to remain anonymous.

Seizures normally are not activated upon until at least 90 days after a notice has been given to the business for non-payment of taxes owed. During which time several phone calls and letters have been made to the business to help rectify the problem.

Businesses must file their tax return and pay their liability by the due date otherwise face property seizures.

The owner of the two Sevier County Zaxby's locations is listed as Tom Day, who is reported to have two partners.

When and if the restaurants will reopen is unclear. There are notes posted on the doors at each Zaxby's locations by the managers.

I ate at the Zaxby's in Seymour one time when it first opened. The parking was a tight and the exit onto Chapman was a safety issue with me. Had several meals at the one in Maryville, but the Seymour store was just too risky for me.

Only in Seymour, maybe a pawn shop can buy the property, hey it has a drive thru window just like the new one next to mcdonalds.

TDR will shut you down for as little as $200 being 90 days late. They also pounce on your business accounts and personal accounts without warning.

You are seriously mistaken. TDR makes several attempts over a period of at least 3 months to settle the matter before they resort to seizure.

If they rent the property and the equipment does not pay the bill, then the property owner pays the balance. New law in Tennessee. So, if you rent a house or building to someone who operates a business from it, TDR can sell to collect unpaid taxes.

I feel that they knew this was going to take place why else were we paid in cash last week.Every other time we could not cash are checks because there was no money in the bank or they bounced in our accounts.

If they owe you wages, call the Tennessee Department of Labor. They can file a claim on the property just like the Tennessee Department of Revenue. Not sure who get paid first, but I believe wages are paid before taxes.
