No exceptions for skylights in the Burg

Gatlinburg Municipal Board of Zoning refused to pass a motion, Thursday, for an interpretation on whether all skylights are considered an exception to Article VIII Footnote 6 of the Municipal Zoning Ordinance.
“The board was not willing to give an interpretation of whether skylights are considered a similar structure” in Footnote 6 of Article VIII, according to David Ball, City Planner.
Architect, Jim Embry asked the board for an interpretation of the Article on behalf of McCormick’s Place Condos, owned by Bruce McCormick.
The property is zoned for C-2, which allows the building to have a maximum height of 84 feet according to Article VIII. Embry’s design calls for a skylight that is an additional 8 feet. Footnote 6 allows a portion of a building to exceed the 84 feet limit, if the item to exceed the maximum height is a steeple, elevator shaft, chimney, stairway, or similar structure.
A review was approved for a front yard and side yard variance for 309 Hilltop Road, zoned R-1. A front yard setback variance was also approved for 346 Autumn Lane, zoned R-1. A height variance for Bear River Lodge was pulled off the agenda by the architect.
