Judge Telford E. Forgety ruled  a new election must be held within 45 to 60 days to decide if liquor can be sold by the drink in Pigeon Forge Jan. 10.

Forgety determined the original vote held in November was flawed due to 289 people voting who should not have voted because their home addresses placed them outside the city limits of Pigeon Forge.

The judge did not find any evidence of fraud or wrong doing in the first decision.
