Charges against Northview Elementary teacher Theresa Ward have been dismissed due to lack of probable cause.
Judge Dwight Stokes dropped the charges last Thursday following a preliminary hearing.
Ward had been accused of denying the request of an eight-year old to use the bathroom, resulting in him soiling himself.  The boy’s mother later claimed her son was made to sit in the soiled clothes for hours while other children mocked him.
Ward’s defense stated the boy was allowed a bathroom break prior to recess and that he asked to go again at the end of the break.  When Ward inquired whether he could hold it for a couple of minutes, he said he could.  The defense denied that the boy was ever in any distress.
Ward was suspended during the investigation, but that has since been reinstated and was back with her class on Monday.
