What would happen if you were selling a home and received several offers – simultaneously? On the other hand, what if you were a homebuyer and knew your offer was only one of three being considered by the sellers? As a seller this seems like a great scenario – but if you’re a buyer, you might have some concerns.
This situation illustrates the importance of representation, and knowing who represents whom. A real estate agent may represent either the seller or the buyer. In either case, agents are obligated to perform to the best of their ability and in the best interest of their client.
In the case of multiple offers, the seller’s agent is obligated to present all offers and to get the best terms possible for the seller. In the interest of treating all parties fairly, however, the buyers’ agent(s) may be made aware of the fact that there are other offers on the table. This allows the buyers’ agent to act in their clients’ best interest as well.
Whether you are the seller or buyer, be certain that you understand who is representing whom. Ask your representative what role they will be playing in the transaction, what they may disclose, and to whom. In the event that multiple offers are being considered, all parties should be able to make informed decisions.
